Terms and Conditions

 

1.      Agreement between User and myticketmyway.com

Welcome to www.myticketmyway.com. The www.myticketmyway.com website (the "Site") is comprised of various web pages operated by myticketmyway.com, LLC ("myticketmyway"). www.myticketmyway.com is offered to you conditioned on your acceptance without modification of the terms, conditions, and notices contained herein (the "Terms"). Your use of www.myticketmyway.com constitutes your agreement to all such Terms. Please read these terms carefully, and keep a copy of them for your reference.

 

www.myticketmyway.com is an online ticket resale marketplace.

 

The website provides an online marketplace for the buying and selling of event tickets. The website does not exist for myticketmyway.com, LLC to buy and sell, but rather provide a marketplace for our users to engage in buying and selling. myticketmyway.com, LLC provides buyer and seller security in the process and receives a percentage of each transaction. The user (buyer and seller) are responsible for compliance with all local laws regarding the buying and selling of event tickets.

 

2.      Electronic Communications

Visiting www.myticketmyway.com or sending emails to myticketmyway.com constitutes electronic communications. You consent to receive electronic communications and you agree that all agreements, notices, disclosures and other communications that we provide to you electronically, via email and on the Site, satisfy any legal requirement that such communications be in writing.

 

3.      Buyer Specific Agreement

A user becomes a buyer and is bound by the buyer agreement whenever the user makes a purchase or an offer on a listing at the Site.

A.    Purchasing Tickets

All purchases and transactions are final. Refunds are only provided in the event the purchased ticket(s) is fraudulent or fails to grant access to the event as described in the listing (see below for the full cancellation/refund policy).

B.     Making an Offer

The Site allows sellers the option to accept offers from buyers on ticket listings for less than the listed price. Listings with this option will have an additional button labled "Make an Offer". When an offer is made, the buyer sets a time limit for how long the offer will remain valid. The buyer may cancel the offer at anytime prior to the seller responding. If the seller accepts the offer, the sale is final and cannot be canceled. You will not be refunded for an accepted offer simply because you no longer wanted the tickets.

The Site provides an option to automatically cancel your offer if another offer is accepted or other tickets are purchased for the same event. If you are not intending to purchase multiple listings, we strongly recommend you use this setting to prevent unintentional purchases. If you purchase tickets through another site, remember to cancel any open offers you are not intending to purchase.

C.     Buyer fees

We have done our best to make our fees the most competitive on the market. Some sites may advertise "no fees", but typically will hide the fees in the price of the ticket. We believe in transparency and in keeping your fees as small as possible. The buyer fee at myticketmyway.com is 10% of the listed price + $1.00 per ticket. This fee does not include shipping costs, which only apply to physical, shipped tickets and will be seen prior to purchase.

D.    SeatcheckTM Guarantee

The buyer is 100% covered for the cost of tickets purchased at myticketmyway.com, including buyer fees, in the event the ticket(s) are fraudulent, not for the correct event, contain restrictions not noted in the listing (i.e. student tickets), different section/row/date than the listing, or have some other flaw that prevents the use of the tickets as expected based upon the seller’s listing. Myticketmyway.com may request the tickets be returned in order to for the buyer to receive the refund. Costs not associated with the ticket purchase, such as travel expenses, are not covered, but the full price of the ticket purchase will be covered.

E.     Local Exchanges

Myticketmyway.com allows for buyers and sellers to set up a local exchange as a method of ticket delivery. No buyer will be forced to use this method of delivery. Every listing that is offered through a local exchange may also be selected by the buyer to be shipped. To set up the exchange, the buyer and seller will be allowed to communicate through a monitored online messaging system on the Site. It is not against the terms of this agreement for buyers and sellers to exchange personal communication information such as email or phone numbers in order to facilitate the exchange. However, myticketmyway.com will be limited in its ability to arbitrate a dispute if communication is handled outside of the provided messaging system. Therefore, myticketmyway.com strongly recommends using the online message system to establish your meeting location and time.

The buyer will be given a tracking number that the seller needs in order to get paid. The buyer will exchange this tracking number for the tickets. The sale is already final, so no monetary exchange will take place.

The buyer and seller assume all risk and responsibility of conducting the exchange, including risks such as injury or death. Myticketmyway.com recommends only meeting in populated places and, if possible, to bring another person along to the meeting.

(i)                 Failed Exchanges

The buyer may be refunded for a failed exchange only if (1) the seller is at fault for the failed exchange and (2) the buyer can show due diligence on their part to make the exchange successful. Myticketmyway.com reserves the right to determine if the buyer has exercised due diligence, but the buyer should know this will include things such as (1) providing multiple options and times for making the exchange, (2) allowing a gracious amount of time for issues such as traffic/unexpected delays that the seller may have (3) a willingness to work out a new time and place if the first exchange failed for some reason. Any activity that appears to be attempting to get out of the purchase and to blame the seller will be grounds for rejecting a refund request and potentially for revoking the buyer access of the site.

F.      E-ticket Transfers

Myticketmyway.com allows for sellers to post electronic tickets that may require the buyer to create an account at a third party website in order to receive and use the tickets. The buyer will be responsible to make the account and provide all requested information to the seller. NEVER GIVE PASSWORDS, SOCIAL SECURITY NUMBERS, CREDIT CARD NUMBERS, OR OTHER SENSITIVE INFORMATION TO THE SELLER. You will be able to see all the requested information from the seller prior to purchasing the tickets. If the seller requests this type of information do not buy these tickets. If you provide all of the appropriate requested information to the seller at the time of the purchase and the seller cannot deliver your tickets you will be entitled to a refund.

Myticketmyway.com does not work with third party e-ticket sites. It is the responsibility of the buyer and seller to abide by the user agreements/policies of those sites. E-tickets, by definition, will not have a paper ticket for use. You will likely need to download an app and/or use a mobile device to enter the event with these tickets.

You will not be refunded for e-tickets that are delivered as promised, but you are unable to access because of personal technological issues (a phone dying, forgetting your password to the third party app, the third party app not working on your device, etc.).

G.    PDF Tickets

Sellers may choose to upload PDF tickets to our site for listing. If you purchase PDF tickets you will receive them via email shortly after your purchase. MANY PDF TICKETS NEED TO BE PRINTED IN ORDER TO ENTER THE EVENT. Do NOT purchase PDF tickets if you are unsure if the venue will scan PDF tickets from a mobile device and you are unable to access a printer prior to the start of the event. You will not be refunded if you are unable to enter because you could not print your tickets.

H.    UPS delivery

Sellers may choose to deliver tickets through UPS. If you purchase these tickets, you will be given options of various shipping services (with various shipping rates). To purchase these tickets you will be required to pay the shipping rate along with a small ship processing fee the Site uses to create the shipping label. Though myticketmyway.com attempts to limit those shipping options to guarantee delivery before the event date, it is the responsibility of the buyer to double deck estimated ship dates and select an appropriate service. The seller has 24 hours to drop off the tickets to UPS after the tickets are purchased. If the seller fulfills their responsibility and the tickets come in after the event date due to the wrong service being selected, the buyer will not be refunded. If the tickets arrive late at the fault of the seller or of the shipping service, the buyer will receive a refund.

I.        Cancellation/Refund Policy

All sales are final and a refund will not be provided except for the following circumstances:

The buyer may receive a refund on purchased tickets (1) if the tickets purchased were fraudulent, in a different section/row than the listing, or were for a different event than the listing, (2) if the tickets were not delivered to the buyer, at no fault of the buyer, prior to the event start time, or (3) if the event was cancelled and not rescheduled. Tickets purchased for rescheduled events can still be used on the rescheduled date. If the buyer is unable to attend the event on the rescheduled date the buyer may re-sell the tickets, but a refund will not be provided.

 

4.      Seller Specific Agreement

ONLY VERIFIED SELLERS WILL BE ALLOWED TO SELL TICKETS ON OUR SITE AT THIS TIME. IF YOU ARE INTERESTED IN BECOMING A SELLER WITH MYTICKETMWAY.COM, PLEASE EMAIL support@myticketmyway.com

A user becomes a seller and is bound by the seller agreement when the user lists tickets to sell on the Site. All sellers must be 18 years of age or older.

A.    Selling Tickets

To sell tickets at myticketmyway.com you will need to create an account, verify your email address, and add a credit card. There is no fee or charge associated with listing tickets on our site. A credit card will only be charged in relation to a selling account in the event the seller fails to fulfill the seller responsibilities as expressed in this agreement. A small seller fee will be taken from each sold listing at the time the listing is sold.

B.     Creating a Listing

Find the event and click “sell your tickets” and follow the steps. Our site offers features that are unique to myticketmyway.com, which will be spelled out below. Be sure to familiarize yourself with these features in order to make the most of your seller experience.

C.     Making an Offer

You have the option to allow buyers to make offers on your tickets. We think that’s important for you as a seller, because sometimes there’s a range of prices you’d be willing to sell your tickets for. Every other site forces you to put a set price on your listing and hope for the best. We want to provide a better, more authentic, selling experience. This is an optional feature. You are not required to allow buyers to make offers on your tickets.

(i)                 Automatically Decline/Accept Offers

Another important feature to keep our sellers from dealing with offers they are not interested in seeing is an auto-decline and auto-accept feature. You have the option of setting an auto-decline price that will decline any offers below that number. You can also set an auto-accept price that will automatically accept offers at or above that price.

SELLER TIP: If you don’t want to mess with offers at all, but want to make your listing more attractive to buyers, you can set the auto-decline and auto-accept to the same price. This way every offer you get below that number will be declined, and once you get an offer that’s acceptable you’ll get an email saying your tickets sold! You won’t even be notified until you sell your tickets.

(ii)              When an Offer is made

If a buyer makes you an offer on your tickets that is not auto-accepted or auto-declined, you will have a specified amount of time (set buy the buyer) to respond. The buyer can also cancel the offer any time before you respond. You can respond by accepting, declining, or making a counter-offer to the buyer. If you make a counter-offer, you will also set a time-limit for how long the offer is available.

Your listing will be active throughout this entire process. If another buyer purchases the tickets while you have an active offer or counter-offer, that offer will simply be canceled.

 

D.    Seller fees

We have done our best to make our fees the most competitive on the market. The seller fee at myticketmyway.com is 5% of the total sell. No other fees will be assigned except fees associated with a failed sale.

E.     Sold tickets

When a buyer purchases tickets the sale is final. You are obligated to deliver the tickets as promised regardless of the circumstances. A failure to deliver on the tickets may lead to a denial of payment along with additional fees. Also, if for whatever reason there is a delay in delivery (even if caused by the buyer), you may under no circumstances use, sell, or re-list those tickets for sale. The tickets rightfully belong to the buyer at that time.

F.      Payment

Your payment will be processed 5-7 business days after your listing is sold. You have the options of receiving a check by mail or being paid through a paypal account.

G.    Delivery

Delivering your tickets as promised is essential to receiving payment and avoiding additional fees. Several delivery methods are available which will be described below.

H.    Local Exchanges

Myticketmyway.com allows for sellers to offer a local exchange as a method delivery. Every listing that allows for a local exchange will also be required to offer a UPS delivery option. To set up the exchange, the buyer and seller will be allowed to communicate through a monitored online messaging system on our website. It is not against the terms of this agreement for buyers and sellers to exchange personal communication information such as email or phone numbers in order to facilitate the exchange. However, myticketmyway.com will be limited in its ability to arbitrate a dispute if communication is handled outside of the provided messaging system. Therefore, myticketmyway.com strongly recommends using the online message system to establish your meeting location and time.

At the time of purchase for a local exchange, the buyer will receive a randomized 16-digit tracking number that you will need in order to get paid. When you meet up for the exchange, the buyer will provide the tracking number in exchange for the tickets. No cash exchange will take place. Input the tracking number online and your delivery will be confirmed.

The buyer and seller assume all risk and responsibility of conducting the exchange, including risks such as injury or death. Myticketmyway.com recommends only meeting in populated places and, if possible, to bring another personal along to the meeting.

If you offer a local exchange, as the seller it is your responsibility to initiate communication for the exchange. Also, the seller has an added responsibility of providing due diligence to make sure the tickets are delivered.

(ii)              Failed Exchanges

The sale may be revoked and additional fees assessed if the seller is at fault for not completing the exchange. The seller must show due diligence to ensure the tickets are delivered. Myticketmyway.com reserves the right to determine if the seller has exercised due diligence, but the seller should know this will include things such as (1) providing multiple options and times for making the exchange, (2) allowing a gracious amount of time for issues such as traffic/unexpected delays that the buyer may have, and (3) a willingness to work out a new time and place if the first exchange failed for some reason. Any activity that appears to be attempting to avoid delivery and to blame the buyer will be grounds for revoking payment, assessing additional seller failure fees, and potentially for revoking the seller access from the site.

I.        E-ticket Transfers

Myticketmyway.com allows for sellers to post electronic tickets that may require the buyer to create an account at a third party website in order to receive and use the tickets. When listing e-tickets, you will create a note for the buyer explaining how they will receive the tickets and what they must provide you, the seller, to send them. This note should include what site they need to make an account at and the specific information you need to transfer the tickets. NEVER ASK FOR PASSWORDS, SOCIAL SECURITY NUMBERS, CREDIT CARD NUMBERS, OR OTHER SENSITIVE INFORMATION FROM THE BUYER. If the buyer provides all the requested information and the seller cannot deliver your tickets, you will not receive payment and may be assessed additional failed delivery fees.

Myticketmyway.com does not work with third party e-ticket sites. It is the responsibility of the buyer and seller to abide by the user agreements/policies of those sites.

J.       PDF Tickets

Sellers may choose to upload PDF tickets to our site for listing.

K.    UPS delivery

Sellers may choose to deliver tickets through UPS. If this option is selected and your tickets sell, you will receive a UPS label via email. You will then have 24 hours to drop off your tickets and the label with UPS. If you fail to drop off the tickets within that time frame your sale may be revoked and you may be assessed additional seller failure fees.

L.     Cancelled Events

If an event is cancelled and rescheduled, the sale will still be considered complete and the seller will receive the payout from the transaction.

If an event is cancelled and not rescheduled, every transaction at myticketmyway.com for the event will be refunded. The buyer will receive a full refund (fees included) and the seller will not receive their payout or, if they have already received a payout, will have their credit card charged the amount of the transaction, less the seller fees.

The seller should seek a refund from the original ticketing source for their tickets. The selling source usually will not need the tickets in order to process the refund. However, if the tickets are needed for your refund, contact our customer support team and we will get in touch with the buyer to return your tickets.

M.   Seller Failure Fees

If a seller fails to deliver tickets, provides fraudulent tickets, delivers tickets that do not match the listing, or delivers tickets with restrictions/limitations not noted in the listing, the seller will receive no payment for the sale and may be charged up to a 50% fee of the cost of the sale. If they have already been paid prior to the discovery of the problem, the seller credit card will be charged the full cost of the sale plus the addition fee of up to 50%.

(i)                 Avoiding the fees

The simplest way to avoid seller fees is to carefully list your ticket and be sure to deliver your tickets as promised. If you believe the buyer is falsifying information about the tickets you delivered, please be ready with any helpful documentation such as original ticket purchase receipts from an official ticket vendor, communications with the buyer regarding the sale, email confirmations of the purchase, receipts of UPS drop-off, emails confirming e-ticket transfers, etc.

 

 

5.      Your Account

If you use this site, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password. You may not assign or otherwise transfer your account to any other person or entity. You acknowledge that myticketmyway.com is not responsible for third party access to your account that results from theft or misappropriation of your account. myticketmyway.com and its associates reserve the right to refuse or cancel service, terminate accounts, or remove or edit content in our sole discretion.

 

 

6.      Children Under Thirteen

myticketmyway.com does not knowingly collect, either online or offline, personal information from persons under the age of 13. It is a violation of this policy for someone 13 years old or under to create or use an account at myticketmyway.com. You must be 18 years of age or older to sell tickets on the site. If you are under 18 (and over 13), you may use www.myticketmyway.com only with the permission of a parent or legal guardian.

 

 

7.      Links to Third Party Sites/Third Party Services

www.myticketmyway.com may contain links to other websites ("Linked Sites"). The Linked Sites are not under the control of myticketmyway.com and myticketmyway.com is not responsible for the contents of any Linked Site, including without limitation any link contained in a Linked Site, or any changes or updates to a Linked Site. myticketmyway.com is providing these links to you only as a convenience, and the inclusion of any link does not imply endorsement by myticketmyway.com of the site or any association with its operators.

 

Certain services made available via www.myticketmyway.com are delivered by third party sites and organizations. By using any product, service or functionality originating from the www.myticketmyway.com domain, you hereby acknowledge and consent that myticketmyway.com may share such information and data with any third party with whom myticketmyway.com has a contractual relationship to provide the requested product, service or functionality on behalf of www.myticketmyway.com users and customers.

 

8.      No Unlawful or Prohibited Use/Intellectual Property

You are granted a non-exclusive, non-transferable, revocable license to access and use www.myticketmyway.com strictly in accordance with these terms of use. As a condition of your use of the Site, you warrant to myticketmyway.com that you will not use the Site for any purpose that is unlawful or prohibited by these Terms. You may not use the Site in any manner which could damage, disable, overburden, or impair the Site or interfere with any other party's use and enjoyment of the Site. You may not obtain or attempt to obtain any materials or information through any means not intentionally made available or provided for through the Site.

 

All content included as part of the Service, such as text, graphics, logos, images, as well as the compilation thereof, and any software used on the Site, is the property of myticketmyway.com or its suppliers and protected by copyright and other laws that protect intellectual property and proprietary rights. You agree to observe and abide by all copyright and other proprietary notices, legends or other restrictions contained in any such content and will not make any changes thereto.

 

You will not modify, publish, transmit, reverse engineer, participate in the transfer or sale, create derivative works, or in any way exploit any of the content, in whole or in part, found on the Site. myticketmyway.com content is not for resale. Your use of the Site does not entitle you to make any unauthorized use of any protected content, and in particular you will not delete or alter any proprietary rights or attribution notices in any content. You will use protected content solely for your personal use, and will make no other use of the content without the express written permission of myticketmyway.com and the copyright owner. You agree that you do not acquire any ownership rights in any protected content. We do not grant you any licenses, express or implied, to the intellectual property of myticketmyway.com or our licensors except as expressly authorized by these Terms.

 

9.      Use of Communication Services

The Site contains chat areas and/or other message or communication facilities designed to enable you to communicate with other users of the site when needed. You agree to use the Communication Services only to post, send and receive messages and material that are proper and related to the particular Communication Service.

 

By way of example, and not as a limitation, you agree that when using a Communication Service, you will not: defame, abuse, harass, stalk, threaten or otherwise violate the legal rights (such as rights of privacy and publicity) of others; publish, post, upload, distribute or disseminate any inappropriate, profane, defamatory, infringing, obscene, indecent or unlawful topic, name, material or information; upload files that contain software or other material protected by intellectual property laws (or by rights of privacy of publicity) unless you own or control the rights thereto or have received all necessary consents; upload files that contain viruses, corrupted files, or any other similar software or programs that may damage the operation of another's computer; advertise or offer to sell or buy any goods or services for any business purpose, unless such Communication Service specifically allows such messages; conduct or forward surveys, contests, pyramid schemes or chain letters; download any file posted by another user of a Communication Service that you know, or reasonably should know, cannot be legally distributed in such manner; falsify or delete any author attributions, legal or other proper notices or proprietary designations or labels of the origin or source of software or other material contained in a file that is uploaded; restrict or inhibit any other user from using and enjoying the Communication Services; violate any code of conduct or other guidelines which may be applicable for any particular Communication Service; harvest or otherwise collect information about others, including e-mail addresses, without their consent; violate any applicable laws or regulations.

 

myticketmyway.com has no obligation to monitor the Communication Services. However, myticketmyway.com reserves the right to review materials posted to a Communication Service and to remove any materials in its sole discretion. myticketmyway.com reserves the right to terminate your access to any or all of the Communication Services at any time without notice for any reason whatsoever.

 

myticketmyway.com reserves the right at all times to disclose any information as necessary to satisfy any applicable law, regulation, legal process or governmental request, or to edit, refuse to post or to remove any information or materials, in whole or in part, in myticketmyway.com's sole discretion.

 

Always use caution when giving out any personally identifying information about yourself or your children in any Communication Service. myticketmyway.com does not control or endorse the content, messages or information found in any Communication Service and, therefore, myticketmyway.com specifically disclaims any liability with regard to the Communication Services and any actions resulting from your participation in any Communication Service. Managers and hosts are not authorized myticketmyway.com spokespersons, and their views do not necessarily reflect those of myticketmyway.com.

 

Materials uploaded to a Communication Service may be subject to posted limitations on usage, reproduction and/or dissemination. You are responsible for adhering to such limitations if you upload the materials.

 

10.  Materials Provided to www.myticketmyway.com or Posted on Any myticketmyway.com Web Page

myticketmyway.com does not claim ownership of the materials you provide to www.myticketmyway.com (including feedback and suggestions) or post, upload, input or submit to any myticketmyway.com Site or our associated services (collectively "Submissions"). However, by posting, uploading, inputting, providing or submitting your Submission you are granting myticketmyway.com, our affiliated companies and necessary sublicensees permission to use your Submission in connection with the operation of their Internet businesses including, without limitation, the rights to: copy, distribute, transmit, publicly display, publicly perform, reproduce, edit, translate and reformat your Submission; and to publish your name in connection with your Submission.

 

No compensation will be paid with respect to the use of your Submission, as provided herein. myticketmyway.com is under no obligation to post or use any Submission you may provide and may remove any Submission at any time in myticketmyway.com’s sole discretion.

 

By posting, uploading, inputting, providing or submitting your Submission you warrant and represent that you own or otherwise control all of the rights to your Submission as described in this section including, without limitation, all the rights necessary for you to provide, post, upload, input or submit the Submissions.

 

11.  International Users

The Service is controlled, operated and administered by myticketmyway.com from our offices within the USA. If you access the Service from a location outside the USA, you are responsible for compliance with all local laws. You agree that you will not use the myticketmyway.com Content accessed through www.myticketmyway.com in any country or in any manner prohibited by any applicable laws, restrictions or regulations.

 

12.  Indemnification

You agree to indemnify, defend and hold harmless myticketmyway.com, its officers, directors, employees, agents and third parties, for any losses, costs, liabilities and expenses (including reasonable attorney's fees) relating to or arising out of your use of or inability to use the Site or services, any user postings made by you, your violation of any terms of this Agreement or your violation of any rights of a third party, or your violation of any applicable laws, rules or regulations. myticketmyway.com reserves the right, at its own cost, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will fully cooperate with myticketmyway.com in asserting any available defenses.

 

13.  Arbitration

In the event the parties are not able to resolve any dispute between them arising out of or concerning these Terms and Conditions, or any provisions hereof, whether in contract, tort, or otherwise at law or in equity for damages or any other relief, then such dispute shall be resolved only by final and binding arbitration pursuant to the Federal Arbitration Act, conducted by a single neutral arbitrator and administered by the American Arbitration Association, or a similar arbitration service selected by the parties, in a location mutually agreed upon by the parties. The arbitrator's award shall be final, and judgment may be entered upon it in any court having jurisdiction. In the event that any legal or equitable action, proceeding or arbitration arises out of or concerns these Terms and Conditions, the prevailing party shall be entitled to recover its costs and reasonable attorney's fees. The parties agree to arbitrate all disputes and claims in regards to these Terms and Conditions or any disputes arising as a result of these Terms and Conditions, whether directly or indirectly, including Tort claims that are a result of these Terms and Conditions. The parties agree that the Federal Arbitration Act governs the interpretation and enforcement of this provision. The entire dispute, including the scope and enforceability of this arbitration provision shall be determined by the Arbitrator. This arbitration provision shall survive the termination of these Terms and Conditions.

 

14.  Class Action Waiver

Any arbitration under these Terms and Conditions will take place on an individual basis; class arbitrations and class/representative/collective actions are not permitted. THE PARTIES AGREE THAT A PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN EACH'S INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PUTATIVE CLASS, COLLECTIVE AND/ OR REPRESENTATIVE PROCEEDING, SUCH AS IN THE FORM OF A PRIVATE ATTORNEY GENERAL ACTION AGAINST THE OTHER. Further, unless both you and myticketmyway.com agree otherwise, the arbitrator may not consolidate more than one person's claims, and may not otherwise preside over any form of a representative or class proceeding.

 

15.  Liability Disclaimer

To the maximum extent permitted by law, this agreement is governed by the laws of the State of Texas and you hereby consent to the exclusive jurisdiction and venue of courts in Texas in all disputes arising out of or relating to the use of the Site. You agree that no joint venture, partnership, employment, or agency relationship exists between you and myticketmyway.com as a result of this agreement or use of the Site. myticketmyway.com’s performance of this agreement is subject to existing laws and legal process, and nothing contained in this agreement is in derogation of myticketmyway.com’s right to comply with governmental, court and law enforcement requests or requirements relating to your use of the Site or information provided to or gathered by myticketmyway.com with respect to such use. If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect.

 

Unless otherwise specified herein, this agreement constitutes the entire agreement between the user and myticketmyway.com with respect to the Site and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between the user and myticketmyway.com with respect to the Site. A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form. It is the express wish to the parties that this agreement and all related documents be written in English.
